Terms of service
1. What we offer. Lovingly Alive creates short, AI-assisted memory films (digital video files) based on photos you provide. Each film is custom-made for you and is an artistic interpretation – it is not real historical footage.
2. Your photos and permissions. By placing an order you confirm that (a) you are at least 18 years old, (b) you own the photos you upload or have the right to use them, and (c) the people shown, or their close family if they have passed away, would agree to the film being made. You may not upload photos of public figures or celebrities, photos of minors unless you are their parent or legal guardian, or any content that is sexual, violent, hateful, defamatory or otherwise unlawful. We may decline or cancel any order that breaks these rules and refund it.
3. Responsibility for content. You are responsible for the photos, names and instructions you provide and for how you use and share the finished film. You agree to indemnify Lovingly Alive against claims from third parties that arise from photos or instructions you supplied or from your use of the film.
4. AI disclosure. Films are created with the help of artificial intelligence. When you share a film publicly, please label it as AI-generated where the platform requires it.
5. Delivery. Films are delivered by email as a download link. Orders paid with PayPal are delivered within 24 hours, orders paid with other payment methods within 48 hours, counted from the time we receive your photos and payment. Custom scenario requests may take longer if we need to clarify details with you.
6. Revisions. If your film does not resemble your loved one or a scene does not match your order, tell us within 14 days of delivery and we will redo the affected scene free of charge.
7. License. You receive a personal, non-exclusive right to keep, watch and share your film with family and friends and on social media. Commercial use of the film is not permitted without our written consent. We will not use your film or photos for advertising unless you give us separate permission.
8. Prices and payment. All prices are shown at checkout including any applicable taxes. Discounts are applied automatically and cannot be combined unless stated.
9. Limitation of liability. To the extent permitted by law, our liability is limited to the amount you paid for the order concerned.
10. Changes. We may update these terms from time to time. The version shown at the time of your order applies.
